The Employees’ State Insurance (ESI) Scheme is a social security scheme for employees in India that provides medical and cash benefits to insured employees and their dependents in case of sickness, maternity, disablement, or death.

Employers are required to contribute a portion of the employee’s salary to the ESI fund and file periodic returns to comply with the scheme’s regulations. The various returns that need to be filed under the ESI Scheme in India are as under:

  1. Monthly Contribution Return (ESI Form-5):

Employers are required to file ESI Form-5 every month, which contains details of employees’ wages, the amount of contribution paid by the employer and employee, and the total amount of contribution deposited in the ESI account. The deadline for filing ESI Form-5 is 15 days from the end of the contribution period.

  1. Half-Yearly Return (ESI Form-6):

ESI Form-6 is a half-yearly return that needs to be filed by the employer. It contains details of the employees, such as their name, age, gender, wages, and family members who are covered under the ESI Scheme. The deadline for filing ESI Form-6 is 42 days from the end of the half-yearly period.

  1. Annual Return (ESI Form-7):

ESI Form-7 is an annual return that needs to be filed by the employer. It contains details of the employee’s wages, the amount of contribution paid by the employer and employee, and the total amount of contribution deposited in the ESI account during the financial year. The deadline for filing ESI Form-7 is 42 days from the end of the financial year.

  1. Return of Declaration Forms (ESI Form-3):

ESI Form-3 is a return that needs to be filed by the employer, which contains details of the new employees who have joined the organization and their family members who are covered under the ESI Scheme. The deadline for filing ESI Form-3 is 10 days from the end of the contribution period.

  1. Return of Contributions (ESI Form-5A):

ESI Form-5A is a return that needs to be filed by the employer, which contains details of the employee’s wages, the amount of contribution paid by the employer and employee, and the total amount of contribution deposited in the ESI account during the financial year. The deadline for filing ESI Form-5A is 30 days from the end of the financial year.

  1. Accident Report (ESI Form-12):

If any employee meets with an accident while working, the employer needs to file an accident report in ESI Form-12 within 24 hours of the accident. The form contains details of the accident, such as the date, time, place, and nature of the injury.
